Employee
Responsibilities
When an employee is first added to a group health
plan, they will receive an initial COBRA notice. It is the employees
responsibility to read that notice in its entirety. The initial COBRA
notice spells out specifically the employers and employees rights and
responsibilities.
Under the law, the employee or a family member has
the responsibility to inform their Plan Administrator of a divorce, legal
separation, or a child losing dependent status under the company's group
health insurance plan within 60 days of the date of the event.
Once a COBRA qualifying event has taken place and
an employee has received a COBRA election notice, the employee has 60 days
(no more) to make an affirmative election. If the employee does not choose
continuation coverage on a timely basis, your group health insurance will
end.
If the employee elects to continue coverage, the
employee has 45 days from the date of the signed election form to pay the
premium to us, including any past premium due and a 2% administration fee.
From that point forward the employee will be responsible
for paying their COBRA premiums to Benefit Solutions on the first of the month for the following month.
Employer Responsibilities
The employer has the responsibility to
notify Benefit Solutions when an employee is added to a group health plan.
We will then send them an initial COBRA notice as reqired by law.
They also notify Benefit Solutions of the
employee's death, termination, reduction in hours or Medicare entitlement.
After we are notified, we notify
the eligible individual that they have the right to continuation coverage. If they choose to continue coverage
within the required 60 days Benefit Solutions will send them payment coupons and collect payments for the remaining COBRA period.
COBRA coverage will be terminated if payments are are
not timely.
